Terms and Conditions and Cancellation

General Terms and Conditions

These General Terms and Conditions apply to SCHERNTHANER TOURISTIK GMBH (Ski and Snowboard School and Ski Rental).

 

1. General:
Unless expressly agreed otherwise, these General Terms and Conditions (hereinafter: T&Cs) apply to all legal transactions and contractual relationships concluded between the Ski & Snowboard Schools in SalzburgerLand and their customers.

The purpose of the Salzburger Ski & Snowboard Schools is the operation of snow sports schools, specifically for ski and snowboard instruction.

This includes providing lessons in snow sports skills and knowledge, particularly skiing and snowboarding (without guaranteeing any specific learning outcome), as well as guiding and accompanying participants in snow sports, especially skiing and snowboarding.

It also includes the paid or free provision or mediation of ski or snowboard equipment upon the request of the contractual partner, for the purpose of enabling the lessons (ski or snowboard rental, including full or partial equipment).

 

2. Reservation, Offer, Order Confirmation, Contract Conclusion, Online Price Requests, and Prices:

  • Reservations for individual and group courses can be made in person, online, or by phone.
  • The offers of the Ski & Snowboard Schools in SalzburgerLand are non-binding.
  • The acceptance of a reservation and the scope of services are solely determined by the written order confirmations of the Ski & Snowboard Schools in SalzburgerLand.
  • Oral or telephone agreements are only valid if confirmed in writing by the respective school.
  • For on-site bookings, a contractual relationship is only established upon purchase or receipt of the required course card.
  • The same applies to bookings via remote communication, with the course card collected before the service begins.
  • In all cases, the course card is issued only after full payment of course fees.
  • Both the Ski & Snowboard Schools and rental providers may employ subcontractors for teaching or equipment provision.
  • All prices are in EURO and, unless stated otherwise, include statutory VAT. Errors in price lists are non-binding.
  • If a group has fewer than 4 participants, the school reserves the right to merge groups or reduce lesson hours.
  • Multiple instructor changes may occur due to flexible organization.

 

3. Cancellation Policy:

For online bookings of ski courses, snowboard courses, private lessons, and packages:

With insurance:

  • Free cancellation up to 2 days before the course.
  • No processing fees.
  • Equipment is insured against breakage and theft.

Without insurance:

  • Up to 7 days before the start: 50% refund (reason required, e.g., medical certificate).
  • Up to 30 days before the start: 100% refund (reason required, e.g., medical certificate).
  • A €25 processing fee applies to all cancellations.

All services and deliveries of the ski school based on online orders are subject to these terms and conditions. Cancellations must be made in writing with the reservation confirmation to skischule@ski-kleinarl.at.

 

4. Online Offers and Bookings:

All online services of the Ski & Snowboard Schools in SalzburgerLand are subject to these T&Cs.

 

4.1. Content of the Online Offer:
The ski & snowboard school / rental (hereinafter "Author") assumes no responsibility for the accuracy, completeness, or quality of the provided information.

Liability claims against the Author for any damages caused by the use or non-use of the information are excluded unless gross negligence is proven.

All offers are non-binding. The Author reserves the right to change, supplement, delete parts of the website or the entire offer, or discontinue publication temporarily or permanently without notice.

 

4.2. References, Links:
The Author is not liable for content on external websites ("links") unless illegal content was known at the time of linking and not removed despite being technically possible.

The Author expressly declares that at the time of linking, no illegal content was recognizable or known. The Author has no influence on current or future content, authorship, or design of linked websites. The Author distances from all contents of linked websites changed after the link was set.

 

4.3. Copyright & Trademark:
The Author strives to respect copyrights and use either self-created or license-free content.

All trademarks mentioned are protected under applicable trademark law and property rights of the respective owners. Copyright of self-created content remains with the Author. Reproduction or use in other publications is not permitted without express permission.

Participants consent to photos being taken during lessons and published online. This consent can be revoked in writing at any time specifying the photo.

 

5. General Participation Conditions:
Participants must inform the school truthfully about their skills and experience and provide appropriate equipment. Participants are responsible for their equipment and safety. Unsafe equipment may lead to exclusion from the course without refund.

Group placement and skill classification are determined by the school. Alcohol or drug influence allows immediate exclusion without refund. Group courses with fewer than five participants may be merged or reduced.

 

6. Liability:
Participants are advised to have health, accident, liability, and travel insurance. The school is liable only for damages caused intentionally or by gross negligence. Participants are responsible for injuries or damages from non-compliance with instructions or unsafe equipment.

 

7. Complaints:
Complaints must be reported immediately on-site. Late complaints may not be considered. Other claims must be submitted in writing within four weeks.

 

8. Withdrawal:
Refunds for group or private lessons are only possible due to accident or illness with a medical certificate. No refunds for no-shows or weather-related cancellations. Lift costs are not included.

 

9. Safety:
Children under 15 must wear a helmet according to ÖNORM EN 1077:2007. Participants must know and follow FIS piste rules.

 

10. COVID-19 Regulations:
Participants must follow all hygiene rules and report symptoms or contact with infected persons. The school is not liable for any COVID-19 related damages or interruptions, including cancellations due to infection, quarantine, or government restrictions.

 

11. Rental Terms for Ski & Snowboard Equipment

  • The renter is fully responsible for the equipment.
  • Equipment may not be transferred to third parties.
  • Payment and ID are required at pick-up. Security deposit or credit card imprint applies.
  • Equipment is insured against theft and damage with varying deductibles depending on equipment class. Fees can reduce deductibles.
  • Theft requires a police report within 24 hours.
  • Equipment must be returned on time; late return may result in a theft report.
  • Equipment must be properly stored to prevent theft.
  • Personal data is processed according to GDPR for booking purposes only.
  • Ski boots are adjusted to bindings according to ISO 11088. Optional top safety setting available for €21.

 

12. Jurisdiction, Place of Performance, Choice of Law:

Place of performance is the central location of the school/rental. Jurisdiction is the local court at the central location. Austrian law applies. Contract language: German.

 

13. Validity of Provisions:

If any provision is invalid, the remaining provisions remain valid. The invalid provision shall be replaced with one economically closest to the original. Changes require written form.
